Anyone been following Russell brand’s rape trial?

That is not in dispute.

Hard legal work has no relation to what is fair as a punishment.

You can work really hard to convict a guy for stealing a loaf of bread.

Exactly.

Meanwhile, hundreds of sickos are making and selling vile images and videos of children being abused and don’t even get a day in jail due there not being enough space.

It’s ridiculous.

The media are treating him likes they’ve caught the next Ted Bundy.

IF someone rims you within 3 mins of meeting you it does suggest you’re up for anal exploration.

She even claimed in a statement to her friend they’d discussed it beforehand.

the crime was she changed her mind and he didn’t realise as he couldn’t see her first and was probably mid orgasm.

Obviously for her the experience was horrific and left her feeling absolutely awful.

However, he prob had a very different idea and then that was that.

he should have been more attentive to her state - yes.

Also note 20 years have gone by.

and other people have chipped in their opinions - including her dad.

Most people are ignorant of the law and how it works, i.e "trial by youtube", "trial by reddit".   This conviction was the result of hard work.  No bullshit.  No shortcuts.   Years of work to gather real evidence that will stand up in a court of law.  English courts don't tolerate bullshit and Russell Brand's theatrics fell flat.

I'm not saying he didn't do it.

But what conclusive evidence was there for rape.

In the anal rape case, she had friends and family testify that she told them what happened at the time.

She said she went to the doctor at the time, but no medical records of her injuries emerged.

There are text messages but no explicit mention of rape.

There is definitely evidence. Whether it's conclusive evidence, you might find a different jury would decide differently.

Clearly you haven't watched any prison documentaries.

Pleasant is literally the last word that comes to mind.

If those documentary makers went to typical US prisons and showed you the reality of them, they wouldn't sell very many documentaries because they're not as extreme as the ones you've been fed.

I'm not familiar with prisons outside the US, but people have a totally warped idea of what US prisons are like.

High-security 'cat a' prisons in the UK are no joke. Massive overcrowding / gangs / drugs / stabbings / murders, not much different to the US.

Earlier this year, a child killer in prison was beaten to death with a metal bar. This is not uncommon. I suspect Russell Brand will be segregated; he'll be an easy target and extorted for money (protection), etc.

@Joshe   This is what Russell will be dealing with.

And I have a feeling he won't get special protection.

The jury that saw the totality of the evidence,( including the defendant's cross examining of witnesses, and due process opportunity to defend himself),  was given the authority to determine the facts for this case.   Everything else is an uninformed opinion.

But the jury is not deciding the punishment.

I know people who have and I've asked them what it's like. I have a cousin who has spent years in 4 different prisons all up and down the US east coast. Inmates are basically free to leave their cells as they please unless there's a lockdown, which is not the norm in most prisons.

Also, violent attacks are nowhere near as common as people think. You can go weeks without seeing a fight, and when they happen, those inmates are sent to solitary confinement and things go on as usual. Also, people aren't getting raped as is portrayed, and gang affiliation isn't as common as portrayed either. The common prison isn't filled with violent gang factions. Sure, they're in there, but it's not like how is portrayed and most people are trying to avoid conflict and trying to survive and do their time to get out.

My cousin is the type of guy who looks for fights. The worst prison he was sent to was when he tried to take on 3 cops, somewhere around Miami. He didn't get in a single fight in all his time in prison, which is probably around 15 years in total. Go figure. Since he didn't have alcohol to enrage him, he didn't want to fight. In many prisons, if you mind your own business and don't go looking for trouble, it's possible to serve your time without getting into a fight.

I suggest you guys watch Orange is the New Black to get a more realistic sense of what prison is like. The writing is based on real life conditions, not some documentary whose success depends on shock factor.

Of course there are minimum, medium, and maximum-security prisons and conditions differ between them.

I just looked up what the conditions of Brand's prison (Wandsworth) would be like in southwest London, and they seem harsher than typical US prisons. According to reports, they're locked up in the cells most of the day with their cell mates. Also, that prison has a big drug problem, which I'm sure Brand will partake in, lol.

The judge (who also saw all the evidence and testimony) will decide based on sentencing guidelines.  In addition to this,  a judge ruled that the evidence was sufficient BEFORE the trial even began.  And in addition, the defense lawyers are sure to appeal and an appelate court will examine the evidence and rule whether the conviction is upheld or overturned.  Russell Brand has been treated fairly and justly.

So far, yes. But if he is sentenced to 10 years, then I say it is unfair.

A judge does not unilaterally decide what fair is.

The appelate court has the  authority to adjust the sentence if it doesn't follow the guidelines or is unreasonable.

Interesting, yeah I think it's the max security prisons which might be more hectic.

Orange is the New Black, isn't that about a women's prison though ?

@Leo Gura Leo could you explain why rape is wrong ? I don't know i mean women love sex, and sometimes things are ambiguous, like she might not give you clear consent, but from her vibe you can tell she wants more. How do you know even if it is considered rape in that case ? Plus part of being a fuckboy is to believe that you're attractive to all women basically, given that premise, you can in rare cases force yourself on a woman, when you had the assumption that she's attracted to you. Plus women are emotional creatures they can tell you no, and not mean it, same way they can tell you yes, but not be super attracted to you, just because you've been together for some time, and you're used to doing stuff together so it becomes automatic.

Like the question of rape is much more complex than it seems. It isn't obvious at all.

I wouldn't suggest anything actually until you have had peanut butter sandwiches for breakfast

By the way, most of the objections here are not objections to this specific case but objections to the legitimacy of the legal system itself.  These are typical questions first year law students ask. So they are legitimate questions but outside the scope of a particular case.
