The core argument of the Section 1983 lawsuit would be that the public stadium authority committed viewpoint discrimination, which is a severe violation of the First Amendment. The Supreme Court has repeatedly ruled that when a government entity opens a facility for public use (like renting out a stadium for entertainment), it cannot deny access or cancel an event based entirely on the political viewpoint of the performer.

In a court of law it takes more than name-calling to present an argument.  The Sheeran Group could have gotten an injunction to provide for the Macklemore performance in the tax-funded stadiums, but not the Gillette stadium which was privately funded.
